Windfall for Golf Clubs - VAT Reclaim Opportunity
A significant VAT reclaim opportunity for not-for-profit members golf clubs in respect of visitors green fees has arisen due to a recent ruling of the European Court of Justice.
In the case of Bridport and West Dorset Golf Club the European Court of Justice held that all supplies of the right to play golf by not for profit members clubs are exempt. Consequently exemption applies not only to members subscriptions but also to visitors green fees.
Eligible clubs will be able to claim a refund of VAT overpaid on visitor green fees but account has to be taken of a consequential affect on VAT recovery on expenses.
There is a 4 year time limit, so it is recommended that action is taken now to maximise the claim as VAT declared on past returns will progressively be falling out of time.
